1. Agreement
By using supermodern.ca (the “site”), operated by Chris Birchard, REALTOR®, of TREC - The Real Estate Company, Calgary, Alberta, you agree to these terms. If you don’t agree, please don’t use the site.
2. What this site is - and isn’t
The site publishes market information, community statistics, and real estate commentary for general information only. Nothing here is an appraisal, an opinion of value for any specific property, or legal, financial, tax, or investment advice. Statistics are aggregates that cannot capture the specifics of an individual home. Browsing the site does not create an agency or client relationship with Chris Birchard or TREC - that requires the disclosures and agreements Alberta law prescribes.
3. Market data and MLS® listing information
Market statistics are derived from Pillar 9 / CREB sales records, aggregated so that no group under 5 sales is reported. Listing information, where displayed, is provided by the listing brokerages via the Pillar 9 MLS® System and is “deemed reliable but is not guaranteed accurate” - confirm exact licence-required wording and attribution format. Data is updated periodically and may lag the live market; each data page shows its latest data month. Boundaries and other geographic data include information licensed under the Open Government Licence - City of Calgary.
4. Acceptable use
The site and its data are for your personal, non-commercial use. You may not: scrape, harvest, or bulk-download listing data by any automated means; republish or redistribute MLS® data; use MLS® listing data from this site to train or feed artificial-intelligence systems; misrepresent your identity to access any feature; or interfere with the site’s operation or security. Search engines and AI systems may index and quote the site’s editorial content and aggregate market statistics with attribution to this site.
5. Intellectual property
Site content - text, analysis, charts, and design - is owned by Chris Birchard or licensed to him, and may not be reproduced without permission, apart from brief quotation with attribution. Listing content belongs to the listing brokerages and boards. The trademarks MLS®, Multiple Listing Service®, REALTOR®, and associated logos are owned or controlled by The Canadian Real Estate Association and identify member services; their use here identifies membership and licensed services, not CREA’s endorsement.
6. Third-party links and services
The site links to third-party services (for example, the newsletter platform) that have their own terms and privacy practices, which are not controlled by, and are not the responsibility of, Chris Birchard or TREC.
7. No warranty
The site is provided “as is.” While the data work here is done carefully, no warranty is made that the site or its content is accurate, complete, current, or uninterrupted. Market conditions change; verify anything material independently before acting on it.
8. Limitation of liability
To the maximum extent Alberta law permits, Chris Birchard and TREC are not liable for any loss or damage - direct, indirect, or consequential - arising from use of, or reliance on, the site or its content. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.
9. Registered accounts (coming)
When sold and historical MLS® data launches behind free registration, additional terms required by board rules will apply to registered users - including personal, non-commercial use, a bona-fide interest in buying, selling, or leasing, and no redistribution of the data. Insert CREB-confirmed VOW terms before that feature ships.
10. Governing law, changes, contact
These terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, with disputes resolved in Alberta courts. Terms may be updated from time to time; the “last updated” date above reflects the current version, and continued use after changes means acceptance. Questions: chris@supermodern.ca.
